This is to let you know that there will be:

A meeting of the Regulation Committee Member Panel of the Kent County Council on:

Tuesday 15 November 2011
at 1.00 pm

Westgate Hall,
Westgate Hall Road,
Canterbury
CT1 2BT.

At this meeting the Panel will decide whether to grant Wickhambreaux Parish Council’s application to register Seaton Meadow as a new Village Green, refuse the application, or to recommend the matter be decided at a public inquiry. The applicant, the landowners and selected members of the public have an opportunity to speak at this meeting.

The Panel Members will be visiting Seaton Meadow

- At 11.00 am on the morning of Tuesday 15 November 2011 in order to familiarise themselves with the site. The Panel Members are county councillors (4 Conservative and 1 Liberal Democrat).

It would help if as many people as possible could attend the site visit and/or the meeting at Westgate Hall so that the councillors are aware of the importance of this issue to local people.

The Panel makes their decision based on a report issued by KCC which summarises the submissions made by the Village Green applicant and the landowners/objectors. This report recommends a Public Inquiry. We support this as it will provide an opportunity for the case to be discussed in depth.

NONSENSE!

Many of you will have received an anonymous flyer in the post on Saturday saying that registration of Seaton Meadow as a village green would prevent cattle grazing there.

It would not normally be our practice to respond to anonymous leaflets however as several phone calls have been received we are responding as follows:

It is not, and never has been, the intention of the Village Green application to prevent cattle grazing on Seaton Meadow.

A number of legal authorities were approached on this very point many months ago. The general view is that there is no problem with cattle grazing on a village green. This is not the correct forum to discuss in detail but rest assured that this issue (and many other legal points) has been discussed with village green experts.

SO COME ALONG to Wickhambreaux Parish Council Meeting at 7.30pm on Tuesday 15th March and hear what your Parish Council have to say.

This statement is published by Seaton Community Action. Whilst we strongly support the Village Green application submitted by Wickhambreaux Parish Council, we do not speak on the council’s behalf.

 

Village Green Application Underway!

These documents are legally supposed to be by each of the stiles at Seaton Meadow. If you see they’ve been removed or you see anyone removing them please notify the authorities. If you’d like a copy to print of and replace at the sites if they’re missing then you can download a copy from HERE >>

PS: It’s a good idea to laminate them or put them in polly pockets to keep the rain off ‘em.

Mr & Mrs Perkins proposal – What do you think?

A Happy New Year to our supporters.  We are all very hopeful that this year will bring a favourable decision on the Seaton Meadow village green application.

In the meantime, at the Parish Council meeting on Tuesday18th January, members of the public present heard that Mr & Mrs Perkins had put an offer to the Council to re-direct their fence in an attempt to halt the vandalism which has been occurring on the meadow.  The prosposed fence line is shown in the map below.  Mr & Mrs Perkins proposed to give the land shaded pink as a “gift in trust” to the village.  Wickhambreaux Parish Council decided unanimously not to accept the offer as it did not provide access to a shallow part of the river where children could play and people could cross.

Seaton Community Action feel the Parish Council were right to reject the offer.  What do you think?

Vandalism:  We would like to repeat the message we posted back in March last year. We urge people not to vandalise any private property on Seaton Meadow and we do not condone any malicious acts.  The village green application is a legal remedy to our problem.  There is no need for vandalism, it doesn’t help.

Seaton Meadow – Village Green Application

We should like to thank everyone who submitted evidence questionnaires in support of the application to register Seaton Meadow as a Village Green. We had a wonderful response and our application is now filed. We now need to wait several months before Kent County Council looks at our application (there is a backlog). Further news, when it becomes available, will be posted on the web site www.seaton-community-action.org.uk.

replacement willow tree: is this good enough?

As many of you are aware Seaton Community Action have been in contact with Canterbury City Council in regards to the removal of the beloved willow tree from the Seaton Water Meadow next to the Black Hole Dyke. The tree was removed on March the 15th, 2010 by the land owners of that particular part of the Seaton Water Meadow. When challenged they retrospectively claimed that the tree was dangerous particularly as it was over hanging Seaton Road and several branches had fallen off earlier in the day.

After a lengthy and drawn out correspondence, including phone calls, photographic evidence, local witness affidavits and expert evidence from a local and well respected tree surgeon we finally received a pronouncement from Jon Lambourne on 20th May 2010.

The main point being and I quote, “I have written to the owner reminding him of the regulations and guidance, and of his duty to plant a replacement tree. If necessary, I will enforce this duty by making a Tree Replacement Order.”

We will now be asking Jon for a deadline for the tree to be planted, and as usual we will be keeping a close watch over the Water Meadow. a major success: footpath to be leveled by order

SCA has successfully put pressure to KCC to achieve this important outcome that will rectify the some of the vandalism of Seaton Water Meadow by the new owners. Andrew Hutchinson the Public Rights Of Way Area Manager (East Kent) wrote to SCA to:

confirm that we intend to now deal with the matter, through serving a 1 month notice for the owner to restore the path surface… If it isn’t restored after the expiry of this timescale the intention is to take direct action to repair the path ourselves and recover the cost from the owner.

The objective of this group is to gather evidence to support the assertion that people have been using the Seaton Grazing Marshes as a recreational space for over 20 years.The earliest image we have is from 1910 and the most recent was 28 Feb 2010. Sadly the area has been fenced off by the new owners preventing public access. If you have images – especially archive images charting the last 20 year and earlier then please post them here. Images of dog walking, picnicking and any other recreational activity featuring people and families using the land are of particular value to our campaign. This appeal also goes out to previous residents of Wickhambreaux, Seaton, Ickham, Stodmarsh, Grove and LIttleborne, who grew up or lived in this area and used the grazing marshes for recreation. Your contributions are gratefully received.

Parish Council members condemned the changes

At last night’s meeting of the Wickhambreaux Parish Council, members condemned the changes taking place on the grazing marsh between Wickhambreaux and Seaton. They agreed to gather evidence to consider applying to register the land as a village green. A village green is defined as land where a significant number of the inhabitants of any locality have indulged as of right in lawful sport and pastimes for a period of at least twenty years. Activities such as children playing and dog walking count as lawful pastimes. They will also make further checks with the City Council about protection afforded by the Conservation Area status, with their arboricultural officer and the Environment Agency.

Parish Council reject offer and Vote to continue Village Green App

At  a meeting of Wickhambreaux Parish Council on Tuesday 15th March 2011 attended by upwards of 35 villagers, including County Cllr Michael Northey and Mr Geoff Preston, (chairman of Ickham Parish Council), the Parish Council considered the offer by two of the owners – Mr & Mrs Perkins - of a gift of a parcel of land in the northern part of Seaton Meadow.  This included supervised access to the river in the summer and a moving of the barbed wire fence to accommodate access to a part of the river.  This offer was conditional on the withdrawal of the Village Green Application.

The meeting was also informed that the anonymous leaflet that had been posted to various local residents was incorrect in its assumption that Village Green registration would end cattle grazing on the Meadow.  Neither was this leaflet produced by Kent County Council as some thought and a statement from Kent County Council was distributed at the meeting to state this and is Click Here.  Additionally the allegation that Wickhambreaux PC had been “unwilling to inform villagers of this fact” was strongly denied.

 

The meeting was then opened up to contributions from the floor.  After careful consideration, a vote (for guidance only as this is not binding on the council) was taken of those villagers attending.  All were in favour of continuing the Village Green application process and rejecting the offer.  The parish councillors then debated the offer and after consideration it was decided to reject the offer.  There were no votes in favour of the offer.  Additionally it was emphasised that the Village Green application would be allowed to run its course and there would be no further negotiations with the owners over offers of this kind.  This was also agreed by the councillors with no votes against.

Seaton Community Action would like to congratulate our Parish Council on their stance on this offer which we consider to be a “red herring”.  The issue is about regaining access as of right to the whole of the meadow and river.  The village does not need a donation of a parcel of land (however valuable from a landowners’s point of view) which could be taken away should any individual choose to start the village green process again.

You may have heard and read in The Gazette about an “offer” from Mr and Mrs Perkins to the Parish Council. At January’s PC meeting a verbal offer about “trusting” a small area in the northern most part of the Meadow to the village was made. As this was verbal and not in writing the Parish Council took no action. A few hours before the February Parish Council meeting a written offer confirming the offer was received and read out in public at the Meeting. It offered some sort of supervised access to the Meadow and access to the river by moving the fence line slightly to a stretch of river nearest Seaton (but not the shallow fordable parts). This written offer we understand will be discussed at the Parish Council Meeting on Tuesday 15th March at 7.30pm. It has apparently been made in order to reduce tension. We make no comment about any detail at this time and presumably the offer will be freely available to examine or at least hear about at the meeting but we will be listening keenly as to how our Parish Council react to this offer. We have faith that the unanimous vote taken by our robust Parish Council a year ago and the work carried out since to apply for Village Green status will be remembered and the reasons why.

art competition winners!

Another good turnout for last Sundays protest walk. A children’s art competition at the school fete and the pictures were placed along the fence for judging by everyone on the walk. There were over 25 fantastic entries from 2 yrs to 13yrs old. It was very close but the winners were

1. Smallest people (pre-school) – Matilda Park (age 3)
2. Small people (KS1, infants) – Chloe Harrison (age 6)
3. Not so small people (KS2, juniors) – Yasmin Egin age 8
4. Not small at all people (secondary, 11+) – joint first Adelaide Sommers (age 11) and Catherine Lane (age 12)

Testimony of the day

As a child of the Fifties, I was a seasoned picnicer. My parents packed me, their dogs and occasionally my grandparents too into my father’s car and headed for Wickhambreaux most Saturdays. The stepping stones across the river at Seaton were one of our favourite destinations and we knew this location simply as the Little Stour… read this an other testimonies here

94 Villagers attended protest!!!

AND many more messages of support keep flooding in from all those who couldn’t come!  The weight of opposition to the fencing off of Seaton Marsh is so strong and todays turnout of 94 people (not including dogs) demonstrated the depth of feeling against this selfish act – perpetrated by a mere handful of greedy individuals.

Village green work is in full swing and the next stage is for local residents to fill in the official evidence packs provided by KCC. These evidence packs will be available shortly and will be delivered to local households. The evidence pack contains a simple questionnaire for you to complete and sign. Photographic evidence is also important so please have a look amongst your old photos.

Packs will also be available at “drop-in” sessions at Wickhambreaux Village Hall on Sunday 18th and 25th April 12-5pm where you can also be given support in completing the pack. The evidence/testimony packs will support Wickhambreaux Parish council in the village green application and is a requirement of the application.

We urge people not to vandalize any private property on Seaton grazing marshes. We support the parish council in their bid for a legal village green application and no not condone any malicious acts which could hinder the application. Although developments on the marshes are frustrating, take comfort in the following quote “Patience and perseverance have a magical effect before which difficulties disappear and obstacles vanish.” !

My parents and I first visited Wckhambreaux over 40 years ago, to enjoy the unique and beautiful landscape and the wonderful tranquility of the village. As an adult I and my family have walked the Seaton Marshes for 27 years, fording the stream and generally enjoying the superb views. We have never in all these years been asked to leave the land, and we have 5 dogs! When I saw the travesty inflicted on that picturesque scene today I was truly appalled. We are all custodians of the land, whether we are walkers, or landowners. To be worthy of being a true landowner one has to realise that we are just a small part of the land’s history. Owning land which is in such a prominent position in such a close knit village gives responsibilities far more important than safeguarding yourself against litigation. Also, have the landowners explored how liable they will be for legal action against them should someone injure themselves on the vicious barbed wire fence – the barbs of which are at eye height for small children? Come on, landowners, live up to your wider responsibilities.
